The "Ghosn" Reality Check: Strict Justice

Japan is one of the safest countries on Earth, but its legal system is terrifying for foreigners who make mistakes.

  • 99% Conviction Rate: If you are charged, you will likely be convicted.

  • 23-Day Detention: Police can hold you for 23 days without charge, with limited access to a lawyer. This is not "innocent until proven guilty"; it is "hostage justice."

Planning your trip timeline? Make sure you check th Best Time to Visit Japan to avoid peak crowd seasons where strict policing is most active.

The "Big Red Line": Strict Bans You Must Know

1. The "Zero Tolerance" Drug Trap

Japan does not mess around with drugs. There is no concept of "personal use amount" for leniency.

  • Cannabis: Possession of even a tiny amount can lead to 5 years in prison and immediate deportation. Do not bring "residue" on your clothes or bags from countries where it is legal (like Canada or Thailand).

  • The Risk: If you are caught, you will likely disappear into the detention system for weeks.

2. The Kyoto "Paparazzi" Ban (Updated 2026)

The Kyoto "Paparazzi" Ban

In Kyoto’s famous Gion district, local patience has run out.

  • The Ban: It is now illegal for tourists to enter private alleys in Gion.

  • The Fine: ¥10,000 (approx. $65 USD).

  • The Rule: Stick to the main Hanamikoji Street. If you see a "No Entry" sign, it is legally binding, not a suggestion. Do not chase Geishas for photos.

3. Shibuya’s "Dry Street" Law

As of late 2024/2025, the Shibuya Street Drinking Ban is in effect year-round, not just on Halloween.

  • The Rule: No drinking alcohol on the streets around Shibuya Station from 6:00 PM to 5:00 AM.

  • The Penalty: Police patrols will confiscate your drink.

The "Traffic & Scooter" Trap

This is the #1 way tourists get fined or detained in Japan.

The "Traffic & Scooter" Trap

The IDP Trap (1949 vs. 1968)

WARNING: Japan ONLY accepts International Driving Permits (IDP) based on the 1949 Geneva Convention.

  • The Trap: Many European countries issue IDPs based on the 1968 Vienna Convention. These are invalid in Japan. If you drive with a 1968 IDP, you are "Driving Without a License," which is a criminal offense punishable by arrest.

  • Check Before You Fly: Your IDP must say "1949 Convention" on the cover.

Electric Scooters (LUUP)

Rental scooters (like LUUP) are everywhere in Tokyo/Osaka.

  • Speed Limit: 20km/h max.

  • Age: 16+ (ID verification required in-app).

  • Alcohol: Strictly Prohibited. Riding a scooter after one beer is the same legal offense as drunk driving a car. You face massive fines (up to 500,000 JPY) or jail.

Substance Rules: Vaping, Alcohol & Meds

Substance Status in 2026 The "Gotcha"
Vaping Legal-ish Selling nicotine e-juice is illegal. You can bring up to 120ml for personal use. You cannot buy refills in Japan.
Alcohol Legal Legal everywhere except specific bans (Shibuya streets at night). 20+ age limit.
Meds (ADHD) STRICT BAN Adderall (Amphetamines) is strictly illegal. Possession equals drug smuggling arrest. Ritalin requires Yakkan Shoumei (import certificate).
Meds (Pain) Restricted Codeine is strictly regulated. Check quantities.

⚠️ Critical Warning: Many common meds (like Sudafed or inhalers) can be illegal. Before you pack, you MUST read our detailed guide on Japan Airport Customs Rules 2026: Alcohol, Meds & Prohibited Items

Niche & "Weird" Laws

No Walking & Smoking in Japan

  • No Walking & Smoking: In major wards like Chiyoda (Tokyo), smoking on the street is banned and results in an immediate 2,000 JPY fine. You must stop in a designated "Smoking Area."

  • The "Skirt Photo" Law: Japan has a specific criminal ordinance against taking photos up skirts or of people in sexualized manners without consent. Shutter sounds on Japanese phones are mandatory by law for this reason.

  • Pocket Knives: Carrying a Swiss Army Knife or pocket knife with a blade longer than 6cm without a "valid reason" (self-defense is not a valid reason) is a crime.

Cultural Taboos (Don't Be Rude)

While not "illegal," breaking these will get you kicked out of establishments.

  1. Tattoos in Onsens: 90% of public baths (Onsens) still ban tattoos (gang association). Cover them with a patch or find "Tattoo Friendly" onsens.

  2. Shoes Indoors: Stepping on the tatami (straw mat) with shoes (or even slippers) is a grave insult. Socks or bare feet only.

  3. Train Silence: Talking loudly on the phone on the train is considered aggressive and rude. Text only.
