Portugals turistlagar i korthet

Portugal kombinerar nationell lagstiftning med kommunala och platspecifika restriktioner. Något som är tillåtet enligt ett nationellt regelverk kan ändå begränsas av en kommun, en myndighet för skyddade områden, en transportoperatör eller en anläggning.

Cannabis är avkriminaliserat i Portugal, inte lagligt

Portugals narkotikapolitik beskrivs ofta alltför brett. Enligt den nuvarande consolidated Portuguese drug law utgör konsumtion, anskaffning och innehav av kontrollerade substanser för personligt bruk administrativa överträdelser snarare än att göra rekreationsdroger generellt lagliga.

Det ofta citerade “10-dagarsmängden” är inte ett lagligt personligt tillstånd. Sedan ändringen 2023 är innehav av mer än den mängd som anses nödvändig för genomsnittlig individuell konsumtion under 10 dagar en indikation på att syftet kanske inte är personligt bruk. Att överskrida den mängden gör inte automatiskt innehavet till ett narkotikabrott.

Om det fastställs att substanserna uteslutande var avsedda för personligt bruk, föreskriver lagen att ärendet ska förbli inom ramen för personligt bruk och hänskjutas till den kommission som ansvarar för det administrativa förfarandet. Odling av kontrollerade växter för personligt bruk behandlas annorlunda och förblir ett brott.

För besökare är den praktiska skillnaden enkel: avkriminaliserat betyder inte lagligt, kommersiellt tillgängligt eller fritt användbart. Använd inte 10-dagarsreferensen som en inköpsgräns, och utgå inte från att någon annan lagligen får sälja eller tillhandahålla cannabis till dig.

Bringing cannabis, CBD or other controlled products across the border is a separate customs question. Do not infer import legality from Portugal’s domestic personal-use rules.

Smoking and nicotine vaping share important restrictions

Portugal prohibits smoking in a wide range of places, including workplaces, healthcare and education facilities, museums, shops, hotels, restaurants and bars, airports, stations, metro facilities and covered car parks. Public transport is also covered by the national framework.

Some categories of premises can provide compliant smoking areas under specified conditions. That does not make the rest of a hotel, restaurant, bar or entertainment venue a smoking area, so posted signs are a safer guide than assumptions based on the type of venue.

Nicotine vaping is not a general indoor-smoking loophole. The consolidated Portuguese tobacco law extends the relevant use restrictions to nicotine-containing electronic cigarettes and certain non-combustion tobacco products that produce inhalable aerosols, vapours, gases or particles. Sales of covered nicotine e-cigarettes and refills to people under 18 are prohibited.

Bringing vaping products into Portugal is a different question from using them after arrival. For import allowances and border treatment, use Portugal Customs Rules: Food, Vapes, Cash & Duty-Free Limits rather than treating domestic smoking rules as customs guidance.

Driving licences, alcohol and electric scooters

Whether you can drive in Portugal on a foreign licence depends on the issuing country and, in some cases, your age, residence status and the licence’s validity.

Valid EU and EEA licences can generally be used until the document expires. Portugal also has special recognition arrangements for qualifying licences from OECD and CPLP countries, while licences covered by bilateral arrangements or road-traffic conventions can follow different rules. For some non-resident drivers using licences from countries with bilateral agreements, the foreign licence can be used for up to 185 days. Licences from countries outside the relevant recognition framework are not valid simply because a rental company accepts the booking.

Before collecting a vehicle, check Portugal’s official foreign-driving-licence guidance for your issuing country and circumstances.

Once you are driving:

• Match the vehicle class: your licence must authorize the exact class of car, motorcycle or other vehicle you intend to drive.

• Keep below the applicable alcohol limit: the general blood-alcohol threshold is 0.5 g/l, reduced to 0.2 g/l for probationary drivers and specified professional or service-driver categories.

• Avoid handheld phone use: Portuguese road rules restrict the use or continuous handling of devices that can interfere with driving.

• Use required restraints: drivers and passengers must use legally required seat belts and restraint systems.

Electric scooters need a separate specification check. A scooter with a maximum continuous motor power of no more than 0.25 kW and a maximum level-ground speed of 25 km/h is treated as equivalent to a bicycle for road-circulation purposes.

ANSR states that electric scooters or similar devices exceeding 0.25 kW or 25 km/h are not currently authorized to circulate on public roads because the necessary technical and circulation regime for that category has not been defined. Rental availability or private ownership does not change that classification.

Drone rules depend on both the aircraft and the location

A small drone is not automatically exempt from Portuguese requirements. ANAC requires operator registration in the open category where the aircraft reaches specified weight or impact criteria and also where it carries a sensor capable of collecting personal data, such as a camera or microphone, unless the relevant toy exception applies. That means many camera drones under 250 g still require operator registration.

ANAC also states that an individual operator visiting from outside the EU who needs Portuguese registration follows the process applicable to an individual operator. Registration of the operator is separate from whether a particular flight is permitted.

Before every flight, check the ANAC geographical-zone guidance. A geographical zone can prohibit an operation, impose conditions or require additional authorization even when the drone itself is otherwise suitable for the open category.

Protected areas can add another permission layer. ICNF states that drone overflight in local and regional protected areas is subject to authorization and directs operators to consult the authority responsible for the relevant protected area. Aviation compliance therefore does not automatically mean that every park or protected landscape is open to drone flights.

Albufeira and Lisbon have local rules visitors can easily misread

Portugal does not have nationwide “tourist behaviour code.” Municipal restrictions need to be identified by place.

Albufeira’s Code of Conduct was published on June 23, 2025 and, under the legal text’s commencement provision, took effect the following day, June 24. It applies throughout the municipality subject to the exceptions written into the code.

Among the behaviours restricted in public roads, places and public transport are:

• consuming alcoholic drinks;

• sleeping or camping;

• full or partial nudity, subject to specific exceptions including partial nudity at beaches and designated hotel outdoor areas;

• preparing food in public space;

• urinating, defecating or spitting, as well as engaging in or simulating sexual acts;

• specified noisy behaviour that harms residents’ health or well-being in residential areas.

There is an important exception to the alcohol rule. The prohibition on consuming alcohol—and the separate prohibition on preparing food—does not apply in duly licensed areas, even when they occupy public space, provided the relevant activity is regularly carried out by the establishment responsible for that licensed area. These are Albufeira municipal rules, not nationwide restrictions that should automatically be applied to Lisbon, Porto, Madeira or another Portuguese destination.

Lisbon has a different type of local alcohol restriction. Since February 14, 2026, the municipality has limited the hours during which alcoholic drinks may be sold for consumption outside covered establishments. The restriction applies from 23:00 to 08:00 Sunday through Thursday and from midnight to 08:00 on Friday, Saturday and the eve of a public holiday.

This should not be rewritten as “public drinking is illegal in Lisbon.” The measure regulates sales for outside consumption during specified hours, rather than imposing a blanket prohibition on possessing or drinking alcohol outdoors. Check the Lisbon municipal guidance if late-night takeaway drinks are part of your plans.

Portugal tourist-law checklist

• Law — Treat drug decriminalization as an administrative personal-use regime, not legalization.

• Law — Follow smoking and nicotine-vaping restrictions inside hotels, restaurants, transport facilities and other covered premises.

• Law — Verify that your foreign driving licence is recognized before renting a vehicle.

• Law — Confirm that your licence covers the exact motorcycle or other vehicle class you intend to drive.

• Law — Check an electric scooter’s power and maximum speed before using it on public roads.

• Law — Check ANAC’s geographical zones before every drone flight and obtain additional protected-area authorization where required.

• Law — Check municipal rules separately in destinations such as Albufeira and Lisbon rather than assuming nationwide alcohol or conduct rule.

• Etiquette — Keep noise down in residential streets and accommodation areas even where a specific local prohibition does not apply.

What matters most before your trip

Three checks prevent the most consequential misunderstandings in Portugal: do not equate drug decriminalization with legalization, verify your driving licence and vehicle class before renting, and check the local rules for the exact municipality or protected area you plan to visit.

For vaping, drones and nightlife in particular, national law may be the first layer. Follow current official guidance and on-site restrictions where you actually plan to smoke, fly, drive or spend the evening.
